GENERAL RETAIL DISCLAIMER AND RELEASE

VACATIONS BY CHRISTY TERMS AND CONDITIONS AGREEMENT

These terms and conditions ("terms") govern the relationship between Vacations by Christy ("we," "our," or "us") and  you the purchaser or traveler ("you," "your," or "client").

1. Acceptance of Terms

Before we make or finalize arrangements for your trip, we require that you acknowledge and agree to these Terms & Conditions. By checking the acknowledgment box and signing in your client portal, you confirm that you have read, understood, and accepted this agreement in its entirety.
Your electronic signature and acknowledgment are legally binding and the equivalent of your handwritten signature.

2. Agency Relationship

Vacations by Christy offers retail travel services that are provided by independent vendors of travel services. We do not operate, control, or provide the services of these vendors directly.
You agree that Vacations by Christy acts solely as your agent in arranging transportation, accommodations, sightseeing, and other travel services. We are not responsible for any loss, accident, injury, delay, defect, omission, or irregularity that may occur due to the act, negligence, or default of any company or person engaged in or responsible for carrying out your travel arrangements.

3. Agent for Suppliers

Vacations by Christy acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other travel service provider named in your itinerary or confirmation (“Suppliers”).
We are not responsible for the acts, omissions, or financial condition of Suppliers, nor for their failure to provide services, adhere to schedules, honor future trip credits, or provide refunds. You agree that any recourse or claim related to Supplier performance lies solely with the Supplier.

You agree that you understand that the supplier has their own terms and conditions and when you work with Vacations by Christy, you automatically agree to the supplier terms and conditions. Details can be found on the supplier booking email that you will receive upon booking.

4. Client Responsibilities

You are responsible for:

• Providing accurate legal names and travel details matching government-issued ID or passports.
• Reviewing all itineraries, invoices, and confirmations for accuracy. This includes dates, flight times, hotel information, car rental information, tours, etc.
• Notifying Vacations by Christy immediately of any discrepancies or errors.
• Complying with all supplier terms, travel requirements, and government regulations.

Vacations by Christy is not liable for any costs or issues resulting from incorrect or incomplete information provided by the client. Please check the itinerary information upon receipt and verify all information is correct.

Travel documents will either be mailed or emailed to you once full payment is received.

5. Payments, Deposits & Refunds

All payments made to Vacations by Christy are nonrefundable unless otherwise stated in writing.
Final payment due dates vary by supplier and must be received by the stated deadline to avoid automatic cancellation.

Refunds, if any, are subject exclusively to Supplier policies. Vacations by Christy is not responsible for Supplier refund denials or delays.

If a Supplier lowers a price after booking, we will attempt to assist with rebooking if permitted by the Supplier; however, success is not guaranteed and additional fees may apply.

6. Service Fees

Professional service, planning, and administrative fees charged by Vacations by Christy are nonrefundable and separate from Supplier charges, regardless of trip completion or cancellation.

7. Changes After Booking

Any changes to a confirmed booking are subject to Supplier change fees in addition to Vacations by Christy’s administrative fee. Change requests must be submitted in writing.

8. Price Increases

Travel arrangements involving airline, cruise, or other Supplier components are subject to supplemental price increases imposed by Suppliers or government authorities even after payment is made.
You consent to such increases and authorize the use of your credit or debit card for any additional charges.

9. Risks of Travel and Release of Liability

Travel involves inherent risks such as delays, cancellations, health hazards, weather disruptions, or unforeseen events including civil unrest or natural disasters.
Vacations by Christy assumes no responsibility and shall not be liable for the acts or omissions of any party not under our control, or for events including but not limited to acts of God, unsafe conditions, terrorism, pandemics, illnesses, or weather hazards.

By booking through Vacations by Christy, you expressly assume all such risks and agree to release, discharge, and hold harmless Vacations by Christy and its employees, affiliates, and subcontractors from any liability related to these risks.

10. Weather Conditions & Natural Elements

Weather and natural conditions (including seaweed, tides, and beach erosion) are unpredictable and beyond our control. Their presence does not constitute grounds for refund or compensation.

11. Vaccination & Health Requirements

Vacations by Christy is not responsible for COVID-19 or other health-related travel requirements that may be imposed by Suppliers or governments, such as vaccinations, testing, health forms, or quarantines.

Rules and requirements are subject to change; it is your responsibility to verify the latest regulations.

12. Entry & Identification Requirements

You are solely responsible for verifying and meeting all passport, visa, and entry requirements for your destinations, including any required parental consents for minors or restrictions based on criminal history.
Passports are typically required to be valid for at least six months beyond entry.

For domestic air travel, as of May 7, 2025, travelers aged 18+ must present a REAL ID-compliant driver’s license or acceptable alternative.

Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. To find information about your destination, please go to www.travel.state.gov.

13. Travel Insurance

Vacations by Christy strongly recommends purchasing travel protection insurance.
Unless you purchase a Cancel-For-Any-Reason policy, most standard policies do not cover epidemics, pandemics, or government travel advisories.
You agree to hold Vacations by Christy harmless for your decision not to purchase insurance or for claim denials by insurers.

14. Credit Card Merchant & Chargebacks

We strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased. If Vacations by Christy processes your payment, we act only as a facilitator, collecting and forwarding funds to Suppliers.
If Suppliers fail to deliver services, your recourse lies solely with them. You agree not to initiate a chargeback against Vacations by Christy for such supplier failures.

15. Force Majeure

Vacations by Christy shall not be liable for any failure to perform due to circumstances beyond our control, including but not limited to natural disasters, pandemics, war, civil unrest, government actions, or transportation disruptions.
Refunds or rescheduling in such cases are subject to Supplier policies.

16. Traveler Conduct

Clients are expected to behave responsibly and respectfully during travel. Suppliers reserve the right to remove travelers for disorderly or unsafe conduct without refund.

17. Privacy Policy

Vacations by Christy collects and uses personal information only as necessary to arrange your travel services. We do not sell or share your information except as required to complete your travel arrangements.

18. Claims & Jurisdiction

You agree to present any claims against Vacations by Christy within 30 days after your trip ends and to file suit within one year of the incident.
All legal actions shall be brought exclusively in the courts of Faulkner County, Arkansas, USA, and you hereby consent to the personal jurisdiction of those courts.

19. Acknowledgment

By checking the acknowledgment box and signing in the tasks portal, you confirm that you have read, understood, and agree to all terms and conditions contained herein. These terms govern all current and future transactions with Vacations by Christy.
